By accessing or using The Nutrition Dynamic ("the Platform"), operated by healthydynamics.ai ("we," "us," or "our"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the Platform.

We may update these Terms from time to time. Continued use of the Platform after any changes constitutes your acceptance of the updated Terms. We will notify you of material changes via email.

2. Eligibility

The Nutrition Dynamic is intended for professionals aged 18 and over who work with clients on food, nutrition, and wellness topics, including but not limited to:

• Nutrition and Health Coaches
• Personal Trainers and Fitness Professionals
• Wellness and Lifestyle Coaches
• Sports and Performance Coaches
• Online Coaches and Content Creators
• Registered Dietitians and Clinical Nutritionists
• Other professionals providing food and nutrition guidance

By using the Platform, you represent that you are a qualified professional and that your use complies with all applicable licensing, certification, and scope of practice requirements in your jurisdiction.

3. The Platform

The Nutrition Dynamic provides AI-powered tools to assist nutrition practitioners, including meal plan generation, nutrient analysis, client progress tracking, and communication assistance. These tools are designed as professional aids, not replacements for clinical judgment.

We reserve the right to modify, suspend, or discontinue any aspect of the Platform at any time with reasonable notice to users.

4. Professional Responsibility

You are solely responsible for:

• All clinical decisions made using or informed by the Platform
• Reviewing and approving all AI-generated content before sharing with clients
• Ensuring your use of the Platform complies with your professional licensing requirements
• Obtaining appropriate informed consent from clients for the use of AI-assisted tools in their care
• Maintaining appropriate professional indemnity insurance

The Platform does not provide medical advice, diagnosis, or treatment. AI-generated meal plans and nutrition recommendations are professional tools that require practitioner oversight and are not intended as direct consumer health guidance. You are responsible for ensuring your use aligns with your professional scope of practice.

5. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorized access.

You may not share your account with other practitioners. Each practitioner using the Platform must have their own account. Team accounts and enterprise plans are available for practices with multiple practitioners.

6. Client Data

You are the data controller for your clients' personal and health information. We act as a data processor under your instruction and in accordance with our Privacy Policy and, where applicable, our Business Associate Agreement.

You are responsible for:

• Obtaining appropriate consent from clients before entering their data into the Platform
• Ensuring your data practices comply with applicable privacy laws (HIPAA, GDPR, etc.)
• The accuracy of client data you enter into the Platform

You own your clients' data. You can export all client data at any time and request deletion upon account termination.

7. Prohibited Uses

You may not use the Platform to:

• Provide nutrition advice directly to consumers without appropriate professional oversight
• Circumvent your professional licensing requirements or scope of practice
• Enter false or misleading client information
• Attempt to reverse-engineer or extract our AI models or algorithms
• Resell or sublicense access to the Platform without written permission
• Violate any applicable law or regulation

8. Intellectual Property

The Nutrition Dynamic platform, including its AI models, software, design, and content, is owned by us and protected by copyright, trademark, and other intellectual property laws.

You retain ownership of the client data and information you enter into the Platform. You grant us a limited license to process that data solely to provide you with the Platform's features.

AI-generated meal plans, analysis, and content produced using your client data are provided to you for your professional use. You may use, modify, and deliver this content to your clients as part of your professional practice.

9. Disclaimers & Limitation of Liability

The Platform is provided "as is" without warranties of any kind, express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or that AI outputs will be accurate or suitable for any particular clinical purpose.

To the fullest extent permitted by law, our liability for any claim arising from your use of the Platform is limited to the fees you paid in the three months preceding the claim.

We are not liable for any clinical outcomes resulting from your use of AI-generated content, or for any professional consequences arising from your use of the Platform in ways that violate your licensing requirements or scope of practice.
